Democrats set to hold Barr in contempt over Mueller report

 

WASHINGTON (AP) — A House committee is poised to hold Attorney General William Barr in contempt of Congress — the opening salvo in what could be a lengthy, acrimonious court battle between House Democrats and President Donald Trump’s administration over special counsel Robert Mueller’s report .

 
House Judiciary Committee Chairman Jerrold Nadler scheduled a Wednesday vote to hold Barr in contempt of Congress, citing the Justice Department’s failure to provide the full text of Mueller’s report by the Monday morning deadline. Nadler, D-N.Y., said Barr’s failure to comply with a subpoena left them with “no choice but to initiate contempt proceedings.”
 
The movement to hold Barr in contempt reflects the deepening rift between Democrats and Barr, whom they accuse of spinning the results of Mueller’s investigation to Trump’s benefit. Barr, in a memo summarizing Mueller’s investigation, said there was insufficient evidence that Trump obstructed justice — a conclusion Democrats fiercely dispute.

Rudy Giuliani defends Ukraine trip to help "defend" Trump

President Trump's personal attorney Rudy Giuliani says it's his right to travel to Ukraine to "defend" his client -- to try to push for investigations that he thinks could be "very helpful" to the president. The New York Times first reported Giuliani's travel plans -- he told the Times that he plans to ask Ukraine's new president, Volodymyr Zelensky, to look into the origins of special counsel Robert Mueller's Russia investigation, as well as former Vice President Joe Biden's son's past connections to the country.

He said there's "nothing illegal" about his effort to pursue probes in Ukraine, since he is not trying to carry out foreign policy initiatives on behalf of the administration.

"[T]his isn't foreign policy — I'm asking them to do an investigation that they're doing already and that other people are telling them to stop. And I'm going to give them reasons why they shouldn't stop it because that information will be very, very helpful to my client, and may turn out to be helpful to my government," he told the Times.

Late Friday morning, Giuliani tweeted, "Explain to me why Biden shouldn't be investigated if his son got millions from a Russian loving crooked Ukrainian oligarch while He was VP and point man for Ukraine. Ukrainians are investigating and your fellow Dems are interfering. Election is 17 months away. Let's answer it now."

Well his businesses at least unless I'm mis-reading. Unless we attribute a companies losses to the guy in charge in which case..... well at least not all of his companies have ceased to exist.

GOP Rep. Amash becomes first Republican to call for Trump's impeachment

Washington (CNN)Michigan GOP Rep. Justin Amash said Saturday he had concluded President Donald Trump committed "impeachable conduct" and accused Attorney General William Barr of intentionally misleading the public.

Amash's comments recommending Congress pursue obstruction of justice charges against Trump were the first instance of a sitting Republican in Congress calling for Trump's impeachment.

Amash said on Saturday that he made his conclusions "only after having read Mueller's redacted report carefully and completely, having read or watched pertinent statements and testimony, and having discussed this matter with my staff, who thoroughly reviewed materials and provided me with further analysis."

"Our system of checks and balances relies on each branch's jealously guarding its powers and upholding its duties under our Constitution," Amash tweeted. "When loyalty to a political party or to an individual trumps loyalty to the Constitution, the Rule of Law -- the foundation of liberty -- crumbles."

White House directs former counsel Don McGahn not to testify before House panel

(CNN)Former White House counsel Don McGahn is not expected to appear Tuesday before the House Judiciary Committee, defying the committee's subpoena and setting the stage for another contempt vote to retaliate against the Trump administration for rejecting the demands of Congress.

The White House argues that as a former senior adviser to the President, he is exempt from having to appear before Congress. The Justice Department's Office of Legal Counsel concluded that former McGahn was not legally required to appear before the House Judiciary Committee and testify about matters related to his official duties as counsel to the President, according to a memo issued Monday and obtained by CNN.

"The Department of Justice has advised me that Mr. McGahn is absolutely immune from compelled congressional testimony with respect to matters occurring during his service as a senior adviser to the President," White House Counsel Pat Cipollone wrote in a letter to House Judiciary Chairman Jerry Nadler.

White House press secretary Sarah Sanders said in a statement that McGahn "cannot be forced to give such testimony, and Mr. McGahn has been directed to act accordingly." "This action has been taken in order to ensure that future Presidents can effectively execute the responsibilities of the Office of the Presidency," she said.

Cohen told lawmakers Trump attorney Jay Sekulow instructed him to falsely claim Moscow project ended

Michael Cohen, President Trump’s former longtime personal attorney, told a House panel during closed-door hearings earlier this year that he had been instructed by Trump lawyer Jay Sekulow to falsely claim in a 2017 statement to Congress that negotiations to build a Trump Tower in Moscow ended in January 2016, according to people familiar with his testimony.

In fact, Cohen later admitted that discussions on the Moscow tower continued into June of the presidential election year, after it was clear Trump would be the GOP nominee. Cohen is serving three years in prison for lying to Congress, financial crimes and campaign finance violations.

House Democrats are now scrutinizing whether Sekulow or other Trump attorneys played a role in shaping Cohen’s 2017 testimony to Congress. Cohen has said he made the false statement to help hide the fact that Trump had potentially hundreds of millions of dollars at stake in a possible Russian project while he was running for president. “We’re trying to find out whether anyone participated in the false testimony that Cohen gave to this committee,” House Intelligence Committee Chairman Adam B. Schiff (D-Calif.) said in an interview. He did not comment on who, if anyone, might have instructed Cohen to lie.

Jane Serene Raskin and Patrick Strawbridge, attorneys for Sekulow, said in a statement that “Cohen’s alleged statements are more of the same from him and confirm the observations of prosecutors in the Southern District of New York that Cohen’s ‘instinct to blame others is strong.’”

During his speech about bailing out farmers, President Donald Trump unleashed on his political opponents, saying that they deserved the death penalty.

“Sir, the Constitution says treason is punishable by death,” one reporter asked Trump at the event. “You’ve accused your adversaries of treason. Who are you talking about?”

Trump claimed, “they’re trying to take down the wrong person.”

“Look at [James] Comey, [Andrew] McCabe, people higher than that,” Trump continued. “If you look at [Peter] Strozk, if you look at his lover, Lisa Page, his wonderful lover. They talked openly. They didn’t use their private server because they didn’t want to get caught. So they used the government server. That was not a good move. He talked about the insurance policy just in case crooked Hillary loses. That didn’t work out well for them. So you look at them.”

Trump gives attorney general Barr sweeping power to declassify intelligence in Russia probe review

President Donald Trump has given Attorney General William Barr sweeping powers over the intelligence community in his review of their role in how the probe began into Russian interference in the 2016 election and surveillance on the Trump campaign.

In an extraordinary move, the president issued a memo Thursday night giving Barr broad authority to declassify information related to the investigation and directed the intelligence community to fully cooperate with Barr's review so that "all Americans learn the truth," according to a statement from White House press secretary Sarah Sanders.

"The Attorney General has also been delegated full and complete authority to declassify information pertaining to this investigation, in accordance with the long-established standards for handling classified information," according to the statement.

"Today’s action will help ensure that all Americans learn the truth about the events that occurred, and the actions that were taken, during the last Presidential election and will restore confidence in our public institutions," she said.

Judge says Deutsche Bank, Capital One can give Trump financial records to House Democrats

A federal judge in New York City on Wednesday said Deutsche Bank and Capitol One can turn over financial documents related to President Donald Trump and his businesses in response to subpoenas from House Democrats.

Judge Edgardo Ramos’s ruling came after a hearing at which lawyers for Trump, his three older children, and the Trump Organization argued that the subpoenas to the two banks should be quashed. His decision came two days after another federal judge, in Washington, D.C., said Trump’s accountants at the firm Mazars LLP had to comply with a congressional subpoena for his financial records.

Deutsche Bank for years has been the main lender for Trump, whom other banks have avoided loaning money to because of his repeated bankruptcies. Capital One is in posssesion of financial records related to the Trump Organization’s hotels. Neither bank had opposed the subpoeanas.

But the Trump family’s lawyers, in a lawsuit filed in late April, challenged the demands for financial documents to the lenders, saying House Democrats “were issued to harass President Donald J. Trump, to rummage through every aspect of his personal finances, his businesses, and the private information of the President and his family.”

Trump has said he is “fighting all the subpoenas” issued by the Democratic-led House.

Flynn's case could prompt release of some redacted parts of Mueller report

Sought-after parts of the Mueller investigation may be made public this week, thanks to a federal judge who's taken an unusual approach in former Trump national security adviser Michael Flynn's case.

Judge Emmet Sullivan of the US District Court in DC set a Friday deadline for the Justice Department to make public unredacted portions of the Mueller report that pertain to Flynn, plus transcripts of Flynn's calls with former Russian ambassador Sergey Kislyak, and of a voicemail during which someone connected to Trump referenced Flynn's cooperation.

Taken together, the judge's orders look like a shortcut to transparency in a moment of executive branch stonewalling.

Each of the documents, once made public, could bring revelations about Mueller's work. The transcripts alone could answer lingering questions about what exactly Flynn said to the Russians that caused so much concern among US intelligence and how a message that factored into the obstruction of justice probe into President Donald Trump played out.
