BREAKING AP - 2nd US embassy official overheard Trump's call with Sondland re: Ukraine investigation

WASHINGTON (AP) — A second U.S. embassy staffer in Kyiv overheard a key cellphone call between President Donald Trump and his ambassador to the European Union discussing the need for Ukrainian officials to pursue “investigations,” The Associated Press has learned.

The July 26 call between Trump and Gordon Sondland was first described during testimony Wednesday by William Taylor, the acting U.S. ambassador to Ukraine. Taylor said one of his staffers overhead the call while Sondland was in a restaurant the day after Trump’s July 25 call with Ukrainian President Volodymyr Zelenskiy that triggered the House impeachment inquiry.

The second diplomatic staffer also at the table was Suriya Jayanti, a foreign service officer based in Kyiv. A person briefed on what Jayanti overheard spoke to AP on condition of anonymity to discuss a matter under investigation.

Yovanovitch responds to Trump tweets at hearing, says he's trying to intimidate

Former U.S. Ambassador Marie Yovanovitch responded in live time to tweets from President Trump denigrating her as she testified in a House impeachment hearing, stating that they were meant to intimidate her.
 
House Intelligence Committee Chairman Adam Schiff (D-Calif.) offered Yavonovitch the chance to respond to Trump after he paused her dramatic testimony to read Trump's tweet.
 
“It’s very intimidating,” Yovanovitch said. “I can’t speak to what the president is trying to do, but I think the effect is to be intimidating.”
 
In his tweet, Trump wrote that "everywhere" Yovanovitch "went turned bad."
 
"She started off in Somalia, how did that go? Then fast forward to Ukraine, where the new Ukrainian President spoke unfavorably about her in my second phone call with him. It is a U.S. President’s absolute right to appoint ambassadors,” he wrote.

(Mother Jones) The blood drained from her face as Marie Yovanovitch, the career diplomat removed as the US ambassador to Ukraine, read the reconstructed transcript of President Donald Trump’s July 25 call with Ukrainian President Volodymyr Zelensky the day it was released. There was the president referring directly to her: “The former ambassador from the United States, the woman, was bad news,” Trump told the Ukrainian leader. And as Yovanovitch read on, she came across another Trump statement that seemed menacing: “She’s going to go through some things.” Testifying before the House Intelligence Committee on Friday morning as part of the ongoing impeachment inquiry, Yovanovitch recalled how she had been “shocked,” “appalled,” and “devastated” to see a president undermine and threaten a US ambassador. And about the same time as she was telling the committee this, Trump was blasting Yovanovitch, claiming, “Everywhere Marie Yovanovitch went turned bad. She started off in Somalia, how did that go?” This was a shocking move that even a Fox News anchor likened to witness intimidation.

 

Yovanovitch’s appearance mainly served to show that Rudy Giuliani, the president’s personal lawyer, conspired with two shady business associates (who have since been indicted for violating campaign finance laws) and corrupt past and present Ukrainian prosecutors to wage a successful smear campaign against Yovanovitch, who had championed anti-corruption measures in Ukraine. But this second day of impeachment hearings showcased an important theme of the Trump years: Trump is a man obsessed with revenge. 

 

The Democrats’ impeachment project has been rather narrowly focused on one episode of Trumpian improbity: Trump exploiting the power of his office to muscle the Ukrainians into producing political dirt he could use against a potential 2020 rival and remove from his electoral victory its Russian stain. Was this an improper or illegal quid pro quo, extortion, or bribery? Did Trump pervert US national security interests to serve his own political and personal desires? These are important issues, but this controversy has also illuminated disturbing aspects of Trump’s character.

 

Trump’s love affair with vengeance is nothing new.

Gordon Sondland Was Texting With Ukrainian Officials on WhatsApp Long Before July 25 Call: WaPo

Gordon Sondland, the U.S. Ambassador to the European Union who had a starring role in President Trump’s anti-Biden crusade in Ukraine, reportedly communicated privately with Ukrainian officials over WhatsApp for months before the now infamous July 25 call between Trump and the Ukrainian president that sparked an impeachment inquiry.

According to sources cited by The Washington Post late Saturday, Sondland was busy texting on WhatsApp with Andriy Yermak, a top aide to Ukrainian President Volodymyr Zelensky, during his trip to Kyiv in late July—the same trip where he was overheard offering Trump reassurances that Zelensky would do “the investigation” and, in fact, “anything” Trump asked for just a day after the July 25 call.

Sondland is said to have used the messaging app for discussions with other Ukrainian officials as well, for months both before the July visit and after, according to the Post. It was not immediately clear who else was included on the messages.

Those messages have apparently evaded scrutiny in the impeachment probe, as the State Department has reportedly refused to turn them over despite a subpoena from the House Foreign Affairs, Intelligence and Oversight committees.

Sondland, who is said to have told another top official he was placed “in charge” of Trump’s dealings in Ukraine despite the country not even being part of the EU, also met one-on-one with Yermak during the same visit, with a State Department aide testifying that he was barred from attending the meeting as a note-taker.

Trump's aides eye moving impeachment witnesses out of White House jobs

Washington (CNN) - President Donald Trump's aides have explored moving some impeachment witnesses on loan to the White House from other agencies, such as Lt. Col. Alexander Vindman, back to their home departments ahead of schedule, according to people familiar with the conversations.

As public hearings bring the officials' allegations to his television screen, Trump is asking anew how witnesses such as Vindman and Ambassador Bill Taylor came to work for him, people familiar with the matter said. He has suggested again they be dismissed, even as advisers warn him firing them could be viewed as retaliation.

The possible move of officials out of the White House could still be viewed by some as evidence of retribution for their testimony. Trump's frustration at his own officials comes as he attacks witnesses on Twitter, including during Friday's public hearing with the ousted ambassador to Ukraine Marie Yovanovitch. Trump appears to have adopted a strategy of maligning the officials, despite some allies encouraging him not to.

The uncertain fate and public thrashing of these officials has created a thorny situation for a White House wading through the impeachment process. Trump's impulse to dismiss them hasn't been realized, but he's made clear nevertheless he views them as unwelcome.

I hope that Pelosi is finally finding effective arguments against Trump. One problem is that at this point even her common sense approach will not be accepted by fanatical Trump supporters locked in their Fox news bubbles.

(Mother Jones) Ahead of the next batch of marathon impeachment hearings this week, House Speaker Nancy Pelosi invited President Donald Trump to answer questions from investigators instead of sounding off on Twitter. 

 

In a Sunday interview with Face the Nation, Pelosi declined to say whether bribery would be among the articles of impeachment filed against Trump and left open the possibility that the inquiry into the president’s conduct would continue into next year. That came days after Pelosi escalated her characterization of Trump’s actions and told reporters that the testimonies heard so far “corroborated evidence of bribery uncovered in the inquiry and that the president abused power and violated his oath.” 

 

During the Sunday interview, Pelosi suggested that House Democrats could decline to file articles of impeachment altogether if they discover exculpatory evidence, and that the president should participate in the inquiry for that reason.

 

“The president could come right before the committee and talk, speak all the truth that he wants if he wants,” Pelosi said.

 

Trump speaking the truth.  Now that would be news.

The initial wave of our survey found that even before articles of impeachment against Trump have been drafted, 56 percent of Americans agree that he has committed an impeachable offense. (We didn’t ask whether respondents believe he should be impeached or removed from office as a result.)

Unsurprisingly, though, there’s an enormous gulf between Republicans and Democrats. Democrats are nearly unanimous in their belief that Trump has committed an impeachable offense, whereas 4 out of 5 Republicans believe that he hasn’t.1
That doesn’t mean, though, that there isn’t room for public opinion to shift as the hearings move forward. The survey also indicated, crucially, that a significant chunk of Americans are still persuadable when it comes to impeachment. While 42 percent of respondents say they are absolutely certain about their position on impeachment, about a quarter still say they’re either “somewhat” or “not at all certain” about whether Trump committed an impeachable offense.

Within this narrower universe of people who haven’t fully made up their mind, respondents who said they currently don’t believe Trump’s behavior is impeachable were especially likely to say they’re not at all certain about their position. It’s important not to read too much into this, since we’re talking about a relatively small slice of the public2 but it suggests that there’s still room for movement among at least some people who aren’t yet on Democrats’ side.

Bit of a bombshell at the start of the evening impeachment hearing.
 


Per new disclosure from DOD's Cooper, emails saying the Ukraine Embassy was inquiring about what was going on with the missing security assistance came in on July 25 -- the very same day President Trump asked Zelensky to investigate the Bidens.

Cooper also makes clear that the delay in approving the aid prevented all of the money from being spent before it expired Sept. 30. She thanks Congress for subsequently approving spending the full funding.

Cooper speaks intensely on the important of the aid in defending Ukraine which is at war every day with Russia; also said it's important more broadly as a message to Russia in other places around the world.

Key part of the GOP defense is that Ukraine didn't even know the aid was on hold so they couldn't be feeling pressure to do the investigations to free it up. But now it appears they did inquire about it on July 25.

Cooper says if we had withdrawn support from Ukraine we would have emboldened Russia and validated Russia's violation of international law in Ukraine.
