The Transgender Ban Is All About Bigotry and Distraction

Introduction:

 

(Counterpunch) The Supreme Court just paved the way for Trump’s ban on transgender people serving in the military to move ahead, at least pending other court challenges. The ban will harm the military and help no one, while doing nothing to address the nation’s real problems.

 

I’m neither transgender nor in the military, but I count several trans people, including trans vets, among my closest friends. I can’t speak for them. I can, however, speak as their friend — and as a sociologist who teaches about gender at the college level.

 

Trump cites the cost of medical care for transgender people undergoing transition as the reason for his ban. Yet many transgender people never have surgery, and those who do may wait until after they’re finished serving in the military to do it.

 

Hormone treatments and gender confirmation surgeries for transgender service members together are estimated to cost $8.4 million annually at most — that’s five times less than the military spends on Viagra. And it’s nearly 200 times less than the Department of Defense spends on health care and lost days of work due to smoking.

 

And yet service personnel are allowed to smoke. In fact, service members at many commands often have an entire culture built around enabling tobacco use, despite all of the costs. If this were actually about the cost of military health care, perhaps a smoking cessation program would be a better option than a transgender ban.

Judge Takes Up Rejection of Gay Student by Campus Christians

Introduction:

DES MOINES, Iowa (Courthouse News) – Lawyers for a Christian student group at the University of Iowa urged a federal judge Friday to find that the college unfairly stripped its status as registered student organization after the group denied a gay member a leadership position.

 

In a case of religious freedom versus gay rights, the campus organization Business Leaders in Christ, or BLinC, wants a ruling in its favor in its lawsuit against the university without going to trial, while lawyers for the university asked the court to try the case but dismiss claims against individually named defendants.

 

U.S. District Judge Stephanie Rose took the parties’ dueling motions under advisement and said she would rule later.

 

BLinC sued the university in December 2017, claiming its registration as an on-campus student organization was revoked by the University of Iowa for denying a leadership post to a gay man and refusing to amend its stated religious beliefs to accept “sexual conduct” that runs contrary to its mission.

 

The university has argued that BLinC’s action violated a human rights policy that bars discrimination against students on the basis of gender identity.

I think people should be able to be who they're and this "law" allows for individuals to do so.

 

I hereby declare to the government that I am the Governor of New York. Also, I'm a black Hispanic transgender disabled Muslim woman, to reap the sweet, sweet affirmative action benefits. The government can't tell me that I'm not!

Unfortunately just as the term “anarchy” has been saddled with negative associations, so too has our concept of “freedom” become muddied in ways that often keep us chained. In wider society “freedom” is often used in very loose ways; if we dislike something we’ll characterize the absence of it as “freedom from” it. This “freedom” refers to nothing more than negation of a given thing. And obviously “not” can never coherently function as a general ideal — “negation” is meaningless when not paired with some specific concept. The absence of one thing always means the presence of another thing.
 
Thus is this sense of “freedom” invoked by authoritarians of all colors. The soldiers and the cops beating us are said to “protect our freedom” — which is to say a freedom from disruption, the freedom to exist in a certain state of affairs, no matter how noxious. The “freedom” to maintain a certain static culture or set of traditions, “free” from change and challenge. This sort of freedom is never anything more than the securing and preserving of some kind of identity, some specific static world. [Most important sentence here] Thus does the conservative quite seriously declare that two gay men holding hands in the public square violates his freedom.

Freedom does not mean freedom of contract. Freedom of contract is the same as death as it only assures stagnation. To never change, or challenge or grow. How is that not different from death itself?

Maryland judge rescinds block against transgender military ban

A federal judge in Maryland cleared the way Thursday for the Pentagon to put in place a Trump administration policy banning most transgender individuals from serving in the military, a move advocates said left only one temporary block in place against the ban.

The ultimate fate of the transgender ban is still playing out in court, although Thursday's decision saw the removal of a nationwide block that had prevented the policy from going into place on a temporary basis. The American Civil Liberties Union, which is fighting the ban, said in a statement following the Maryland ruling that "one additional block on the ban still exists from a different case."

In January, the Supreme Court enabled the policy to go into effect while legal challenges proceeded in lower courts, but US District Judge George Russell had not lifted his court's injunction on the ban, preventing the Pentagon from moving ahead.

That changed on Thursday, when Russell agreed with the Justice Department that in light of the Supreme Court's ruling, the nationwide injunction should no longer stand.

The Iowa Supreme Court unanimously ruled on Friday in favor of two transgender women, effectively striking down the state’s ban on Medicaid coverage for sex reassignment surgery.

The case involved EerieAnna Good and Carol Anne Beal, two women whose medical providers determined that sex reassignment surgery was necessary to treat their gender dysphoria. Yet when Good and Beal — who have identified as female since childhood — sought to have surgery under the state’s Medicaid program, they were denied. They appealed to the state agency, which oversees the program, but were rejected again.

“So many people still don’t understand that this is not something we need for trivial or cosmetic reasons,” Good said. “It’s medical care a doctor is recommending for someone who has a medical need for it."

Good and Beal sued the agency in 2017. In June, Judge Arthur Gamble of the Judicial District 5 Court ruled that a 1995 Iowa Department of Human Services policy denying Medicaid coverage for sex reassignment surgery violates the state’s 2007 Civil Rights Act, which added gender identity to the state’s list of protected classes.

Pentagon sets limits on transgender troops

WASHINGTON (Reuters) - The U.S. Defense Department signed a memo on Tuesday that would enforce limitations on transgender people serving in the military, a policy that has been the subject of court challenges.

The policy will take effect on April 12 and will bar most transgender individuals from serving if they require hormone treatments or transition surgery.

The memo, signed by David Norquist, currently the No. 2 official at the Pentagon, will allow service secretaries to issue waivers on a case-by-case basis.

President Donald Trump announced in July 2017 a ban on transgender people serving in the military. He later accepted Pentagon recommendations to limit the ban to individuals with a history of gender dysphoria, defined as “those who may require substantial medical treatment,” and allowing some exceptions.

United Airlines Adds Nonbinary Booking Option

When booking travel, customers are typically forced to identify as one of two binary genders, male or female, a dilemma for customers who do not identify within this parameters. On March 22, United Airlines announced that they'd be the first United States airline to offer nonbinary gender options in all their booking channels. United travelers will have the option to use the gender neutral honorific Mx. (instead of Mr. or Ms.) during booking and in a MileagePlus customer profile. Customers can also identify as M(male), F(female), U(undisclosed) or X(unspecified), corresponding with the gender indicated on their passports or authorized identification.

“United is determined to lead the industry in LGBT inclusivity, and we are so proud to be the first U.S. airline to offer these inclusive booking options for our customers,” United's Chief Customer Officer Toby Enqvist said in a news release. “United is excited to share with our customers, whether they identify along the binary of male or female or not, that we are taking the steps to exhibit our care for them while also providing additional employee training to make us even more welcoming for all customers and employees.”

To help implement inclusive change, United has worked with LGBTQ rights organization Human Rights Campaign, as well as the The Trevor Project on employee training initiatives including teaching employees about preferred pronouns and the persistence of gender norms, LGBTQ competency in the workplace and other steps to make the airline an inclusive space for customers and employees.

"At the Human Rights Campaign, we believe being acknowledged as the gender you identify with is part of treating everyone with dignity and respect," Beck Bailey, acting director of the Workplace Equality Program, said in a news release. "By providing non-binary gender selection for ticketing and the gender-inclusive honorific Mx. in user profiles, United Airlines is taking an important step forward for non-binary inclusion."

Brunei implements stoning to death under new anti-LGBT laws

 

Brunei is introducing strict new Islamic laws that make sex between men an offence punishable by stoning to death.

The new measures, that come into force on Wednesday, also cover a range of other crimes including punishment for theft by amputation.

The move has sparked international condemnation.

The sultan of the small south-east Asian nation on Wednesday called for "stronger" Islamic teachings.

"I want to see Islamic teachings in this country grow stronger," Sultan Hassanal Bolkiah said at a public address, according to AFP news agency, without mentioning the new laws.

Brunei's gay community has expressed shock and fear at the "medieval punishments".

Transgender no longer recognised as 'disorder' by WHO

 

Transgender health issues will no longer be classified as mental and behavioural disorders under big changes to the World Health Organization's global manual of diagnoses.

The newly-approved version instead places issues of gender incongruence under a chapter on sexual health.

A World Health Organization expert said it now understands transgender is "not actually a mental health condition".

Human Rights Watch says the change will have a "liberating effect worldwide".

Trump State Dept. Bans LGBT Pride Flag From Flying on Flagpoles at All US Embassies

Secretary of State Mike Pompeo's State Department has banned the LGBT Pride flag from being flown from flagpoles outside all U.S. embassies. The Trump administration has quietly been waging war against the LGBTQ community, including just this week announcing it is axing federal funding of HIV treatment testing research.

Under the Obama administration embassies around the world did not even have to ask if they could fly the gay pride flag outside – blanket permission was automatically granted.

But according to NBC News, four U.S. embassies – Israel, Germany, Brazil and Latvia – have requested to fly the LGBT Pride flag for Pride month, including the U.S. embassy in Germany, where the Ambassador, Richard Grenell, serves as the highest-ranking gay official in the Trump administration. All requests were denied.

High court judges in Botswana have ruled that laws criminalising same-sex relations are unconstitutional and should be struck down, in a major victory for gay rights campaigners in Africa.
 
Jubilant activists in the packed courtroom cheered the unanimous decision, which came a month after a setback in Kenya when a court rejected an attempt to repeal similar colonial-era laws.
 
“Human dignity is harmed when minority groups are marginalised,” Justice Michael Leburu said as he delivered the judgment. “Sexual orientation is not a fashion statement. It is an important attribute of one’s personality.”
 
The ruling was welcomed enthusiastically by campaigners across the African continent, where homosexuality is illegal in most countries. In several, gay people face life imprisonment or the death penalty.

Ecuador Court votes to legalize same-sex marriage in landmark decision

Ecuador has voted in favor of marriage equality in a landmark ruling today (12 June).

Confirming the hopes of local activists, the country’s Constitutional Court ruled to legalize same-sex marriage in the country.

Today’s ruling centered on whether the Inter-American Court Ruling of January 2018, which recognized same-sex marriage, compels Ecuador to legalize same-sex marriage.

Germany plans to ban all conversion therapies under a new law to be introduced this year by German Health Minister Jens Spahn.

It’s estimated there are around 1,000 attempts in Germany each year to “re-educate” LGBT+ people, according to the Magnus Hirschfeld Foundation. These include efforts by family members, coaches and therapists, prayers and sometimes even exorcisms.



Spahn, who is gay and married to a man, told a Berlin press conference on Monday (June 10): “My position is clear: homosexuality is not an illness, which is why it does not need to be treated.

Beto: I Promise I’ll Let Boys Compete In Girls’ Sports

Since Beto O’Rourke began tanking in the polls after his initial boomlet, he’s been scrambling for ways to push further to the left than some of his more successful (thus far) opponents. His latest bid in this effort is a new LGBT platform that was rolled out this week. In it, he promotes the LGBTQ+ Equality Act, which we’ve discussed here previously. Beto focuses on things like housing, education and employment, but makes no mention of the negative impact this measure will have on the already threatened world of competitive female sports. (Daily Caller)

Democratic presidential candidate Beto O’Rourke’s new plan on LGBT issues includes forcing schools to include male athletes who identify as transgender girls on female sports teams.

O’Rourke’s plan for “LGBTQ+ Equality,” which he released Wednesday, includes passing the Equality Act, which would amend the Civil Rights Act of 1964 to make “sexual orientation and gender identity” protected characteristics under federal anti-discrimination law.

The House passed the Equality Act in May with unanimous Democratic support, but it’s unlikely to get a vote in the Republican-controlled Senate.

“Beto will work with Congress to ensure that every person in our country is safe and respected,” O’Rourke’s plan states, pledging to get the Equality Act passed.

A request for comment on the question of how this agenda will affect female athletics from the O’Rourke campaign was not answered.

Democratic presidential candidate Elizabeth Warren has said all transgender Americans should be able to access affordable, gender-affirming healthcare.

Warren, 70, who is currently senator of Massachusetts, recently added her pronouns to her Twitter and campaign bios in what is being hailed as a show of solidarity with the trans community.

In an August 13 tweet, Warren said that “the Trump administration is trying to roll back important protections for trans Americans” and linked to a website called Protect Trans Health, run by the National Center for Transgender Equality and the Transgender Law Center.

The Trump administration took its hardest line yet to legalize anti-gay discrimination on Friday when it asked the Supreme Court to declare that federal law allows private companies to fire workers based only on their sexual orientation.

An amicus brief (1) filed by the Justice Department weighed in on two cases involving gay workers and what is meant by Title VII of the Civil Rights Act of 1964, which bans discrimination "because of sex." The administration argued courts nationwide should stop reading the civil rights law to protect gay, lesbian, and bisexual workers from bias because it was not originally intended to do so.

That view conflicts with some lower court rulings that found targeting someone for their sexual orientation is an illegal form of both sex discrimination and sex stereotyping under Title VII. Those courts have found, to illustrate the point, that a gay man wouldn't be targeted if he were instead a woman dating a man; thus he faced discrimination because of his sex.

But the administration said in its brief Friday that Title VII's ban on sex discrimination only prohibits unequal treatment between "biological sexes," as it argued last week in a related brief against transgender rights, in which the Justice Department said companies should be able to fire people because they are transgender as well.

Congress did not explicitly say that the meaning of sex in Title VII encompasses LGBTQ people, so, the administration argues, the law cannot apply to sexual orientation. Federal lawyers are asking the Supreme Court, for the first time, to explicitly limit the Civil Right Act's protections to exclude LGBTQ people.
