The Under-the-Radar Legal Battle Protecting Health Care for Trans People

Shauntae Anderson lived for the weekends. Growing up Black and transgender in a small West Virginia city in the 1990s, she spent a lot of time alone, hiding her self-knowledge from her mom and coping with ridicule from classmates. Yet on Friday and Saturday nights, she could lock herself in her room, put on Whitney Houston or Aretha Franklin, and try on the few pieces of women’s clothing she’d stashed away. “I would put those things on, put makeup on, and look at myself in the mirror. Make myself so I felt pretty,” Anderson, now 46, says. Yet the night always had to end. “Silent tears would just flow down my face as I’m wiping it off,” she remembers.

When she came out to her doctor as a teen, Anderson says she was told there was nothing they could do for her. As an adult without health insurance, she wanted her body to change so badly that she tried popping birth control pills for their minuscule dose of hormones. It wasn’t until she was 40 years old and incarcerated in a federal prison that a doctor finally agreed to treat her gender dysphoria, the medical diagnosis for what she’d been going through.

Finally getting the prescription hormones she’d needed for so many years was “liberating,” Anderson says. Her skin softened; her breasts grew. Her cellmate, also trans, pointed out gradual changes in her figure.

The article then explains that while Shauntae could obtain prescription hormones, transition surgery was not an option allowed by insurance or personal budget constraints.
In late 2021, Anderson agreed to join a lawsuit challenging West Virginia’s Medicaid exclusion for gender-confirming surgery. The case, filed by the LGBTQ civil rights organization Lambda Legal and local partners, argued that West Virginia was violating federal anti-discrimination law by denying coverage for surgical procedures used to treat gender dysphoria, while approving them for other diagnoses.

Last August, they won: A federal judge threw out West Virginia’s Medicaid exclusion. “The same or similar surgical treatments are available…when the diagnosis requiring that treatment is not gender dysphoria,” District Court Judge Robert Chambers wrote in his ruling, pointing to mastectomies as an example. “When treatment is precluded for a diagnosis based on one’s gender identity, such exclusion invidiously discriminates on the basis of sex and transgender status.”

Parliament passes long-awaited amendments to Finland's transgender law

The proposal was approved by a vote of 113 to 69.

Finland's Parliament has voted 113-69 in favour of making changes to the nation's transgender laws.

There were 17 MPs absent from the vote, and no abstentions.

The result means that transgender individuals can legally change their gender by self-declaration alone, without having to undergo a lengthy medical process — including a psychiatric assessment — as under the previous law.

The changes will also see the abolition of a requirement that transgender people must be unable to reproduce.

Under Finland's previous law, transgender people were required to provide a medical certificate proving they are sterile, in order to legally confirm their true gender.

Prime Minister Sanna Marin (SDP) had previously said that getting the amendments through parliament during this term in office was a priority for her government, but the proposal hit several stumbling blocks as it made its way through parliamentary committees.

Japan PM fires aide over derogatory LGBT remarks

Japan's Prime Minister Fumio Kishida has fired a government aide who made derogatory remarks about LGBT couples.

Masayoshi Arai reportedly said he would not want to live next to, or look at, people in same-sex relationships.

Mr Arai also warned that permitting gay marriage in Japan would lead to many abandoning the country.

Mr Kishida said the remarks were "outrageous" and "completely incompatible" with his government's policies.

Japan - a country still largely bound by traditional gender roles and family values - is the only G7 nation that does not recognise same-sex marriage.

However, recent polling suggests most Japanese support gay marriage.

Church of England backs plans to bless gay couples

The Church of England has backed proposals to allow prayers of blessing for same sex couples.

Its position on gay marriage will not change and same-sex couples will still be unable to marry in church.

The plans, set out by bishops last month, have been criticised from those who think they go too far and those who think they don't go far enough.

The motion was passed in all three of synod's 'houses'.

The Archbishop of York, the Most Revd Stephen Cottrell, said priests would have the option to bless gay couples, but could choose not to.

SAN FRANCISCO – The San Francisco Pride (SF Pride) board of directors have selected Suzanne Ford as executive director. Serving as interim executive director since February of 2022, Ford will continue to spearhead the funding and operations for one of the country’s premier Pride celebrations.

“I am excited for the first trans person to hold the position of Executive Director at San Francisco Pride,” said Nguyen Pham, President of San Francisco Pride. “We are privileged to have Suzanne at the helm of many key projects as she continues to advocate for trans visibility while championing diversity in the LGBTQ+ community.”

“In joining SF Pride, I found a great way to give back to the LGBTQ+ community and I found my family,” said Ford. “I want to preserve the legacy of the parade, while making sure there will be a thriving SF Pride event for future generations. As a tight-knit team, we are excited and humbled to host the second in-person SF Pride Parade and Celebration post pandemic.”

Following a rewarding sales career in the private sector, Ford served as a board member for approximately five years, acting as treasurer for the last three of those years. She co-founded SF Pride’s Pro-Am Golf Tournament Fundraiser, the world’s first and currently only PGA-endorsed LGBTQ+ golf event, which has raised more than $200,000 over the past four years.

Trans activists in Hong Kong win landmark victory for gender identification

Hong Kong’s highest court recently gave trans people a big victory by ruling that gender-affirming surgery should not be required before someone can legally change their gender on identity cards.

The case was brought about by two trans men – Henry Edward Tse and someone only identified as Q – protesting the current government policy stating that they could not change the gender on their identity cards until they had their ovaries and uteruses removed as well as surgery to construct male genitalia.

The court declared that policy unconstitutional and said it created an “unacceptably harsh burden,” according to the AP. It ruling also said the current rules create “confusion or embarrassment” for those who present as a gender that conflicts with what is on their identity card.

Spanish senate gives green light to new trans law

The majority of the Senate gave approval on Wednesday February 8th to the 'trans law', however, it will still have to go back to the Congress of Deputies before being finalised.
The Ley de Trans recognises gender self-determination and develops a series of measures to guarantee the rights of the LGBTQIA+ community.

The bill passed with 144 votes in favour, 108 against and 2 abstentions.
The Minister for Equality, Irene Montero, has celebrated this new step in, her words, one of the “most important laws of the legislature” and has ensured that it “effectively reaches every corner of the country” despite the fact that there is “resistance to its application”.

After the long debate on Wednesday, no new amendments have been added.

In a sentence, the new Trans Law simplifies the gender self-identification process. It states that any person over 16 years old will be able to legally change their name and gender on official ID documents by simply completing a basic administrative procedure.

LGBTQ Organizations Report a recent Uptick in Twitter Hate

(TechCrunch) Twitter is still in the early days of its Elon Musk era, but the company’s new owner hasn’t hesitated in leaving his mark on the social network.

According to a new survey from GLAAD, Amnesty International, and the Human Rights Campaign, prominent LGBTQ accounts are already noticing a difference on the platform under Musk’s leadership.

Out of 11 LGBGT organizations surveyed, five reported experiencing more frequent abuse and hate speech following Musk’s takeover in late October. None of the groups saw a decrease in targeted hate during the same time period.

When asked if their organization had encountered a similar uptick in hate on other social networks, 90% of the respondents said that the increase in harassment was limited to Twitter. All of the organizations reported encountering hate speech and harassment on Twitter, whether in the pre or post-Musk eras.

The survey, which focused on accounts with more than 10,000 followers, is far from comprehensive, but it was designed to capture a “snapshot” of the social media landscape in the early months following Musk’s $44 billion takeover. After buying Twitter, Musk quickly reversed many of the company’s content moderation decisions, including some high profile cases that set an ominous precedent for the platform’s many LGBTQ users.

It is getting scary in the United states for LGBT people that is for damn sure.
