Former President Donald Trump won't get another chance to have a new trial in the civil suit with longtime columnist E. Jean Carroll, nor will the $5 million dollars in damages she won be reduced, after federal Judge Lewis Kaplan rejected Trump's bid for a retrial. In May, Trump was found liable for defaming and sexually abusing Carroll, who has long claimed he assaulted her in a department store dressing room in 1996 and subsequently slandered her by publicly refuting her allegations. Since then, Trump has openly denied Caroll's accusations, even filing a counterclaim arguing that she defamed him during a CNN appearance in which she confidently maintained her assertions against him

A lengthy memorandum, which took into account the two separate lawsuits Carroll had filed against the ex-president, acknowledged that the "only point on which Ms. Carroll did not prevail was whether she had proved that Mr. Trump had 'raped' her within the narrow, technical meaning of a particular section of the New York Penal Law."

"The jury's unanimous verdict in Carroll II was almost entirely in favor of Ms. Carroll," the opinion continued, adding, "The finding that Ms. Carroll failed to prove that she was 'raped' within the meaning of the New York Penal Law does not mean that she failed to prove that Mr. Trump 'raped' her as many people commonly understand the word 'rape.' Indeed, as the evidence at trial recounted below makes clear, the jury found that Mr. Trump in fact did exactly that."

At least one witness is expected to appear Thursday before the grand jury in Washington, D.C., investigating former President Donald Trump's efforts to overturn the 2020 election, sources tell ABC News.

Trump aide Will Russell previously appeared before the grand jury, so Thursday would be a return appearance. Russell served in the Trump White House as a special assistant to the president and the Deputy Director of Advance before moving to Florida to work as an aide to Trump after he left the White House.

Special counsel Jack Smith informed Trump on Sunday that he is a target in the election probe, suggesting that another indictment of the former president could be imminent.

As ABC has previously reported, multiple witnesses have appeared before the grand jury in recent weeks, including Trump's son-in-law and former White House senior adviser Jared Kushner.

Fulton County Prosecutors Prepare Racketeering Charges in Trump Inquiry

(The Guardian) The Fulton county district attorney investigating Donald Trump’s efforts to overturn the 2020 election results in the state of Georgia has developed evidence to charge a sprawling racketeering indictment next month, according to two people briefed on the matter.

The racketeering statute in Georgia requires prosecutors to show the existence of an “enterprise” – and a pattern of racketeering activity that is predicated on at least two “qualifying” crimes.

In the Trump investigation, the Fulton county district attorney, Fani Willis, has evidence to pursue a racketeering indictment predicated on statutes related to influencing witnesses and computer trespass, the people said.

Willis had previously said she was weighing racketeering charges in her criminal investigation, but the new details about the direction and scope of the case come as prosecutors are expected to seek indictments starting in the first two weeks of August.

The racketeering statute in Georgia is more expansive than its federal counterpart, notably because any attempts to solicit or coerce the qualifying crimes can be included as predicate acts of racketeering activity, even when those crimes cannot be indicted separately.

Trump attorneys expected to meet with special counsel's office as potential indictment looms: Source

Lawyers for former President Donald Trump have arrived at special counsel Jack Smith's offices this morning for a meeting as a potential indictment of the former president looms, sources familiar with the matter tell ABC News.

Trump's attorneys, John Lauro and Todd Blanche, are expected to meet with Smith's team following the receipt of a target letter alerting Trump he is a target of the special counsel's investigation into efforts to overturn the 2020 election.

The target letter, sent on July 16, mentions three federal statutes: conspiracy to commit offense or to defraud the United States, deprivation of rights under a civil rights statute, and tampering with a witness, victim or an informant, sources familiar with the matter told ABC News.

Trump confirmed the letter in a post on his Truth Social platform.

Trump faces additional charges of obstruction of justice, retention (W/superseding indictment)

Donald Trump asked a staffer to delete camera footage at his Florida estate in an effort to obstruct the federal investigation into his possession of classified documents, according to an updated indictment unsealed Thursday that adds new charges against the former president and names an additional defendant.

The indictment includes new counts of obstruction and willful retention of national defense information, compounding Trump's legal jeopardy even as he braces for a possible additional indictment in Washington over his efforts to overturn the results of the 2020 presidential election. The additional counts underscore the extent of the yearlong investigation into Trump that first produced charges last month in the form of a 38-count indictment against Trump and his valet, Walt Nauta.

A Trump spokesperson dismissed the new charges as "nothing more than a continued desperate and flailing attempt" by the Biden administration "to harass President Trump and those around him" and to influence the 2024 presidential race.

The reporter makes this comment at the end of the article: "It marks a notable shift in the prosecution’s approach to Trump’s case, charging him for retaining a document it alleges the former president knew was highly sensitive after he left office — and not just for failing to return it to the government when asked."


The superseding indictment can be found below. The first mention I see of defendant De Oliveira is on page 24, when he helps Nauta carry boxes.

Bottom of page 28: De Oliveira asks Trump Employee #5 not to tell anyone Nauta was "coming down" because that trip was supposed to be kept secret. Page 29, Nauta wanted De O' to ask Trump employee #4 how long security footage was kept. On June 29th, Nauta and De O' walked through the tunnel and pointed out surveillance cameras. Later that night, De O' had a private conversation regarding the security cameras with Trump Employee #4, which he asked to remain secret. He asked how many days the footage was retained on the server, was told it was about 45 days -- and then said "the boss" wanted the server deleted! Trump employee #4 said he told De O' that he should reach out to a Trump security supervisor, and De O' insisted that "the boss" wanted the server deleted.

On page 30, Trump reaches out through Trump employee #5 to ask if De O' is loyal. On hearing that he was, Trump called De O' and said he'd get him an attorney.

Security preparations begin at Fulton courthouse for possible Trump indictment

Orange barricades were set up outside the entrance to the Fulton County Courthouse, the first visible sign of extra security ahead of the expected indictment of former president Donald Trump next month.

In a statement issued late Thursday, a spokeswoman for the Fulton County Sheriff’s Office said the agency is coordinating with local, state and federal law enforcement to enhance security ahead of “high-profile legal proceedings.”

“Some of the measures we are deploying, such as barriers that will limit parking near the courthouse, will be obvious to the public,” Natalie Ammons said. “For security reasons, other measures being deployed will not be as obvious.”

The sheriff’s office asked the public and anyone conducting business at the Fulton courthouse to “plan accordingly” to ensure they arrive on time for hearings, meetings and other proceedings.

Fulton County District Attorney Fani Willis reaffirmed in a local news interview that she will announce charging decisions by September 1 in her investigation into efforts by Donald Trump and his allies to overturn Georgia’s 2020 presidential election result, while applauding the ramped-up security measures around the local courthouse.

“The work is accomplished,” Willis told CNN affiliate WXIA at a back-to-school event over the weekend. “We’ve been working for two and half years. We’re ready to go.”

Judge Rejects Trump's Effort to Short-Circuit Georgia Election Case
A Georgia judge on Monday forcefully rejected an effort by former President Donald J. Trump to throw out evidence collected by a special grand jury and to remove the current prosecutor from the investigation into Mr. Trump’s attempts to overturn his 2020 election loss in the state.

Judge Robert C. I. McBurney of the Fulton County Superior Court wrote in a nine-page order that Mr. Trump did not have the legal standing to make such challenges before indictments were handed up. The judge said the “injuries” that Mr. Trump claimed to have suffered from the two-and-a-half-year investigation “are either insufficient or else speculative and unrealized.”

The order comes on the cusp of the investigation’s culmination. The office of the Fulton County district attorney, Fani T. Willis, a Democrat, is expected to present potential indictments in the matter to a regular grand jury by mid-August.

A “special purpose” grand jury, which did not have indictment power, interviewed dozens of witnesses and subpoenaed documents over the course of roughly seven months. Then, the jury issued an advisory report that recommended the indictment of a number of people for violations of Georgia laws, according to the jury forewoman.
